Work Shouldn’t Cost You Your Wellbeing

Work should bring structure and security - not anxiety, disrespect, or fear. But if your job environment feels toxic or unsafe, you're not imagining it. Being harassed, ignored, or mistreated wears on you. It can affect your confidence, your health, even your home life.

Our experienced employment law attorneys at Horn Wright, LLP, have stood up for workers near South Street and around Town Hall who were tired of being mistreated. Whether you need a workplace discrimination lawyer or someone who will advocate for you, we're here.

Tired of the "Just Kidding" Excuse? Harassment at Work Is Never Funny.

Someone makes a comment. They laugh it off. They expect you to stay quiet. But you don’t feel safe. You feel targeted. That’s not a joke. That’s harassment.

Maybe it started with one remark. Then came the texts. Now, the idea of walking into your office near Route 106 fills you with dread. That reaction is real. It matters.

Harassment can include:

  • Comments about your appearance, gender, or background. These remarks can isolate you and create an uncomfortable or even threatening environment. It might be comments about your clothes, jokes tied to your race, or assumptions based on gender identity. Nearly 60% of workers report this.
  • Unwanted touching or standing too closePhysical boundaries matter. Even subtle or repeated contact - like shoulder grabs, brushing past you, or getting too close at your desk - can be intimidating. Many cases stem from repeated unwanted contact.
  • Cold treatment after you speak up. Harassment doesn’t always sound loud. Sometimes, it shows up in silence - being ignored in meetings, left out of emails, or treated like a problem. That’s retaliation. The US Equal Employment Opportunity Commision investigates this more than anything else.

If something doesn’t feel right, speak up. You may qualify for a hostile work environment claim.

Working Overtime and Getting Underpaid? That’s Wage Theft.

You stay late. You skip breaks. You cover extra shifts. Then you check your paycheck. The numbers don’t match.

That’s not a mistake. That’s wage theft.

Some employers hope you’ll stay silent. They reduce hours. They deny overtime. That’s against the law.

Wage theft shows up in different ways:

  • No time-and-a-half for overtime. Under New York law, employers must pay overtime to most hourly employees who work over 40 hours a week. Some businesses try to avoid this by simply not recording extra hours worked.
  • Told to work “off the clock.” This can include anything from setting up before your shift to closing duties after your shift ends. If your employer tells you to clock out and then asks for “just one more thing,” that’s. Millions of workers lose wages this way.
  • Paid in cash with no records. This arrangement may hide wage violations or tax evasion. Without documentation, proving how many hours you worked or what you were promised becomes difficult and that's exactly why some employers prefer it.
  • Called “exempt” when you’re not. Some roles are exempt from overtime laws, but many aren’t. If your job doesn’t involve managing others or exercising independent judgment, you may still qualify for overtime. Misclassification affects thousands of salaried workers across the country. Salaried workers still qualify for overtime in many cases

If this sounds familiar, you may have a case involving unpaid wages and overtime disputes.

Feeling Targeted After Speaking Up? You're Not Imagining It.

You reported a problem. You wanted things to improve. But now you get fewer shifts. You face extra write-ups. You feel watched.

That’s retaliation. It’s illegal under state and federal law.

New York protects workers who speak out. If your boss punishes you for reporting something, that’s a red flag.

Retaliation may include:

  • Fired after reporting a problem. Your employer might not say it's because you spoke up, but the timing tells a different story. Being let go after filing a complaint may violate Section 740 of the New York Labor Law.
  • Moved into worse shifts or positions. Suddenly you're off the schedule or reassigned to less favorable duties. These changes may not be random. They're often used to make someone quit on their own.
  • Coworkers start ignoring you. After speaking out, you might notice people stop including you. This isolation can lead to a toxic environment and counts as retaliation under EEOC guidelines. That’s workplace exclusion and it’s a form of harassment.

If you were fired unfairly, you may need wrongful termination legal help.

They Count on You Staying Silent. You Don't Have To.

Some employers break the law and hope you won’t notice. Others assume you won’t speak up. They rely on fear.

Deadlines Don’t Wait. If You Delay, You Could Lose Everything.

In New York, employment laws include strict deadlines. If you miss one, your case could end. You may have only 180 days to act.

The clock starts ticking the moment something happens. Waiting can cost you. Evidence disappears. Memories fade. Employers take advantage of delays.

If something felt off, trust that feeling. Let’s protect your rights before it’s too late.
